    Well, from my experience as I was the executor of my parents estate, it is all governed by state laws and statutes. In Florida, all estates must go thru probate...a process that allows for legal advertisement of the death and notification for claims against the estate with a deadline for those claims to be registered with the court. Once that has been done, the court reviews the deceased will if one exist or applies the applicable state laws to the settling of the estate. In my case, we provided a plan to carry out the directives of the will, got approval of the plan, executed that plan, provided the court with proof of execution, then the court released me from my charge of executor of the estate.

    Hope that helps.......but you probably will have to find legal assistance from someone familiar with estate laws of the state in which the deceased lived when they died.

    thx thore. in my case there is a trust fund set up, so the executorship (if thats a word) is ongoing and not being carried out in an unbiased manner. Personal feelings are fueling judgment calls. I really am trying to find a way to either make this guy do what is said in the will by the numbers or relieve him of his duties.
